Aldi has reached an out of court settlement with its former Brussels sprout and brassica suppliers John Clappison and Matthew Rawson who had been suing the retailer for £3.7 million after claiming they were delisted without sufficient notice, in contravention of the Groceries Supply Code of Practice (GSCOP) according to The Grocer.
The High Court ordered a halt to the proceedings on 1 October after recording that the parties had come to a ‘confidential settlement’. The case would have reached the High Court next year in the absence of an agreement.
Unusually, in December Groceries Code Adjudicator (GCA) Mark White requested to be included in the case, something that Aldi’s lawyers had objected to arguing it could be seen as a “partisan” move. However, in July the courts approved White to advise on evidence in the hearing.
All parties have declined to comment further on the agreement according to The Grocer.
